Retainer Agreement for Canadian Citizenship Services
INTRODUCTION
By registering for services through Canada Citizenship Help (canadacitizenshiphelp.ca), you ("the Client") are entering into a formal agreement with Canada AG Immigration & Citizenship Services, retaining the services of a Regulated Canadian Immigration Consultant (RCIC) to act on your behalf, in accordance with the terms outlined herein.
This Agreement is entered into pursuant to the rules and bylaws of the College of Immigration and Citizenship Consultants (CICC), the national regulatory body for immigration consultants in Canada.
1. DEFINITIONS
Unless otherwise stated, terms used in this Agreement shall have the meanings prescribed in the CICC Service Agreement Regulation and By-law.

RCIC: The authorized representative from Canada AG Immigration & Citizenship Services, licensed under membership number R534755.

Client: A person or entity whose interests the RCIC agrees to represent.

Authorized Representative: A professional licensed under Canadian law to provide immigration/citizenship advice or services.

Designate: A person authorized in writing by the Client to act on their behalf.

Disbursements: Miscellaneous expenses incurred during representation (e.g., courier fees, IRCC filing fees).

Service Agreement: This contract outlines the RCIC’s duties and the Client’s obligations.

IRCC: Immigration, Refugees and Citizenship Canada.
2. RCIC RESPONSIBILITIES
The RCIC agrees to act on behalf of the Client to obtain a Canadian Citizenship Certificate, and will:

Provide professional advice regarding citizenship eligibility and the process.

Complete all required forms and review documentation in accordance with IRCC standards.

Provide the Client with a personalized checklist of required documents.

Submit the completed application to IRCC promptly.

Maintain regular communication and respond to reasonable inquiries.

Manage correspondence with IRCC on the Client’s behalf.

Act in the best interest of the Client, within the limits of the law.
3. CLIENT RESPONSIBILITIES
The Client agrees to:

Provide all required documentation upon request.

Ensure documents are in English or French (or include certified translations).

Be truthful and accurate; any misrepresentation may result in termination of this Agreement without a refund.

Notify the RCIC of any direct contact from IRCC.

Inform the RCIC of any change in address or contact information.
-
In joint representation cases, consent to information-sharing among jointly represented parties.
4. BILLING METHOD
The Client will pay a flat professional fee and an administrative fee online at the time of registration. These fees do not include IRCC government processing fees, which are billed separately.
5. PAYMENT TERMS
All fees (professional, administrative, and federal) must be paid in full by credit card at the time of registration. The RCIC will remit government fees to IRCC upon submission of the application.
6. REFUND POLICY
Fees are non-refundable unless the RCIC fails to complete the responsibilities outlined in Section 2. Refunds are not issued for delays or refusals by IRCC. If granted, refunds will be issued using the original payment method.
If the Client cannot contact the RCIC due to death or incapacity, they may contact the CICC for further assistance.
7. DISPUTE RESOLUTION
Disputes related to the Code of Professional Ethics must first be addressed in writing to the RCIC, who has 30 days to respond. If unresolved, the Client may file a formal complaint with the CICC:

8. CONFIDENTIALITY
All personal and sensitive information received by the RCIC will remain confidential and used solely for immigration representation unless disclosure is required by law. The Client agrees to electronic communication and secure data storage.
9. FORCE MAJEURE
The RCIC shall not be held liable for any failure to perform duties under this Agreement due to circumstances beyond their control (e.g., war, pandemic, changes in legislation).
10. AMENDMENTS
Material changes to the Client’s circumstances or to immigration law may require modifications to this Agreement. All changes must be made in writing and agreed upon by both parties.
11. TERMINATION
This Agreement shall be terminated when:

All tasks outlined in Section 2 are completed, or
-
Material changes in the Client’s situation or eligibility render continuation impossible.
12. WITHDRAWAL / DISCHARGE

The Client may terminate this Agreement in writing at any time. Outstanding fees will be adjusted accordingly.

The RCIC may withdraw from representation under conditions outlined in Article 11 of the Code of Professional Ethics, provided the Client is not prejudiced.
13. GOVERNING LAW
This Agreement is governed by the laws of Ontario and the federal laws of Canada. Unless otherwise provided for under Section 7, any disputes shall be resolved in Ontario's courts.
14. MISCELLANEOUS

This Agreement represents the entire understanding between the Client and the RCIC.

All sections are severable; invalid provisions do not affect the validity of the rest.

The Client acknowledges having had the opportunity to seek independent legal advice and confirms understanding and acceptance of all terms.
